[UPDATE] Following the publication of this story, a Bang With Friends Inc. representative told GameSpot that it has not yet personally seen the lawsuit from Zynga. "We heard through media reports that Zynga has filed a trademark infringement claim with respect to the 'with friends' part of our name," the representative said. "As a technology company, we take intellectual property seriously and will evaluate the case in detail once we receive a copy. Regardless, we continue to be focused on making our users happy, so that they can help each other be happy." The original story follows below. Social game giant Zynga has sued the developer behind casual sex app Bang With Friends, claiming the company's software infringes on Zynga's trademark for its "with friends" suite of games. Zynga is the owner and operator of various "with friends" games, including Words With Friends and Chess With Friends. According to a complaint filed in San Francisco federal court yesterday (via Bloomberg), Bang With Friends Inc. registered the domain name last year. According to the complaint, Bang With Friends Inc. "selected the name 'Bang With Friend' for its casual sex matching app with Zynga's game trademarks fully in mind." The complaint claims Bang With Friends directly infringes on Zynga's games Words With Friends and Chess With Friends. Zynga is seeking a court order to prohibit Bang With Friends Inc. from using the Bang With Friends name in the United States and unspecified damages. The Bang With Friends app taps into a user's Facebook account and matches people up with other friends who have deemed themselves "interested" in the other person. Bang With Friends Inc. could not be reached for comment at press time. Last week, Zynga reported a $15.8 million loss and revealed it lost nearly half of its daily active players year-on-year. The Wii U Basic model will see a $100 markdown at Wal-Mart in Canada, and will sell for $199, according to a scan of the retailer's latest advertisement obtained by Gimme Gimme Games. The markdown will go into effect on Friday, August 2, according to the advertisement. The 8GB Basic model currently retails for $300, while the 32GB Deluxe edition goes for $350. A Nintendo representative was not immediately available to comment on Wal-Mart's advertisement. Nintendo has had a tough time moving Wii U units since launch, selling only 160,000 systems during the April-June quarter and 3.61 million systems overall. Asda, a Wal-Mart subsidiary and the United Kingdom's second-largest supermarket, stopped stocking the Wii U in its stores this week. Nintendo plans to sell 9 million Wii U units before March 2014. The company is hoping to spur console sales by releasing numerous first-party titles in the coming months, including The Legend of Zelda: The Wind Waker HD, Wii Party U, Donkey Kong Country: Tropical Freeze, Super Mario 3D World, and Wii Fit U. Blizzard Entertainment will make a "special announcement" during a Gamescom press conference on August 21, the World of Warcraft and Diablo studio announced today. The news comes from an invitation sent to media today that reads, "We're making a special announcement that's sure to capture the attention of the Heavens, Burning Hells, and all the shadowed places that lie between." The event itself will take place on the first day of Gamescom, August 21, at 11:30 a.m. local time. Gamescom takes place August 21-25 in Cologne, Germany. GameSpot will be on-hand at the event. Blizzard Entertainment has a number of projects in the pipeline, including Diablo III for consoles, Blizzard All-Stars, Hearthstone: Heroes of Warcraft, StarCraft II: Legacy of the Void, and a next-generation MMO, in addition to continued support for World of Warcraft.
