Sony settles lawsuit with Kevin Butler actor Jan 17th 2013, 14:58 Jerry Lambert agrees to not endorse any of Sony's competitors for two years.
Jerry Lambert, the actor who played Kevin Butler in dozens of PlayStation adverts, has settled a lawsuit with Sony over his appearance in a commercial for Bridgestone tyres. As part of the terms of the settlement, reported by MediaPost, Lambert admitted that the advertisement may have caused confusion and that his contract with Sony meant he was unable to promote products from other video game companies. Lambert has agreed to spend the next two years not appearing to promote “any other video game or computer entertainment system or video game company.“ Once Lambert's two years on the naughty step have played out, he has also agreed to spend the next two years giving Sony the heads up in any subsequent advertisement which endorses a competitor's product. The Kevin Butler character still remains in the possession of Sony, as you might expect, although we haven't seen Sony use the character in a while. The original lawsuit came about in September 2012 after Lambert was seen playing a Nintendo Wii in a US advertisement for the tyre manufacturer Bridgestone, with players able to pick up one of Nintendo's consoles as part of a promotion. Later the advert was edited to remove Lambert, as Sony alleged that their contract with Lambert stopped him from endorsing their competitors, and that Bridgestone had essentially poached the Kevin Butler character. Bridgestone, however, denied that Kevin Butler was featured in the advertisement. "Use of the Kevin Butler character to sell products other than those from PlayStation misappropriates Sony“s intellectual property, creates confusion in the market, and causes damage to Sony," said Sony at the time. While Sony and Lambert have now settled their differences, the publisher is still engaged in a legal tussle with Bridgestone. Nintendo today announced its spring 2013 release plans for North America, scheduling Lego City Undercover to arrive March 18 for Wii U, followed by Monster Hunter 3 Ultimate a day later on Wii U and 3DS. In addition, a second entry in the Lego City series--Lego City Undercover: The Chase Begins--will come to 3DS April 21. That game is a prequel to the Wii U game and follows the efforts of Chase McCain during his early years on the force. Other Wii U titles getting release dates today include The Walking Dead: Survival Instinct (March 26), Need for Speed: Most Wanted (March 19), and Rayman Legends (February 26). The Wii U version of Aliens: Colonial Marines will be available by the end of March. Nintendo also divulged release dates for 3DS games Brain Age: Concentration Training (February 10), Luigi's Mansion: Dark Moon (March 24), and Pokemon Mystery Dungeon: Gates to Infinity (March 24). On top of revealing release dates for various Wii U and 3DS games, Nintendo today announced it will launch a Wii U GamePad Accessory Set February 4. This pack will include a screen-protector for the GamePad, an extra-large stylus, and a cleaning cloth. It will sell for $13. A Facebook post from Sony's German PlayStation account states LucasArts' new action game is slated for a release in 2013. LucasArts has made no mention of a release date or platform availability for Star Wars: 1313 since it announced the game in May 2012. Star Wars: 1313 was first announced in May 2012. The internally developed third-person action adventure game will see players take on the role of a bounty hunter navigating a subterranean metropolis, Level 1313, beneath the surface of the planet Coruscant. The game is being developed with the help of artists across the Lucasfilm organisation, including LucasArts, Industrial Light & Magic, Lucasfilm Animation Ltd, and Skywalker Sound. The game will be based on the Unreal engine and feature full-body performance capture. Star Wars: 1313 may not be the only new Star Wars game on the horizon. A listing for an Xbox Live Arcade game Star Wars: First Assault appeared last year. This project has not been formally announced. Capcom has announced a second title update for Resident Evil 6, further tweaking the game's options and adding additional features to last year's often-criticised take on the survival horror series. The free update will go live on January 22 and offer a handful of changes, reports Capcom Unity, notably allowing the QTE Assist feature to be used across all difficulty levels, which should make the lives of anyone attempting a run-through on Professional a lot more bearable. Some unspecified levels have also had their difficulty tweaked. There's also the option to replay specific levels from the game's lengthy chapters, which should make the serpent emblems a lot easier to collect. Finally, the game's Agent Hunt multiplayer mode will now be available to all players from the beginning. Previously, gamers were required to complete one of the game's campaigns to access the mode. Capcom addressed some of the game's complaints--such as the close-up camera angles and the locked-off Ada Wong campaign--in its last title update, which was released in December. Resident Evil 6 received a 4.5 in its GameSpot critique, with the review stating that "this long, poor sequel is the ultimate test of patience for even the most dedicated." Halo 2 PC multiplayer will end February 15, 343 Industries has announced in a new blog post. The company said it has been monitoring the game's online population for months, finding that peak concurrent user levels reached only about 20 players. Halo 2 for PC's multiplayer over LAN and single-player will remain available, though all other network services will be switched off at the time. "We love you, Halo 2 PC, and you will live forever in our hearts," the company said. Halo 2 PC launched in May 2007, more than two and a half years after the original Xbox version was released. It was ported to the PC by internal Microsoft team Hired Gun, which has since been dissolved. The game runs only on Windows Vista. Gamers holding out for a high-definition Halo 2 remake are out of luck, as Microsoft said last year that it has no plans for such a game. Grasshopper Manufacture has announced a release window for its upcoming action game Killer Is Dead. According to the latest issue and online preview from Famitsu, the game will be out in Japan this summer for Xbox 360 and PS3. The game's story takes place in a future where both traveling to the moon and human cybernetic implants are possible. Players control an agent called Mondo Zappa, who is given the task of executing criminal targets for the Execution Office. Aiding him are his female boss, Vivian Squall; his assistant, Mika Takekawa; and the head office chief cyborg Brian Roses. The main antagonist is a cyborg named Victor, who can manipulate human emotions with the use of sound. The game is billed as an action title where the highlight is melee combat with swords. Mondo's left arm can transform into a gun or a drill; options for upgrading it further are available in the game. Striking enemies will allow players to absorb their blood, which is used to charge up Mondo's Adrenalin Burst that can clear the screen full of enemies. Killing enemies with the special move unleashes dark matter; there is no word on what this energy will be used as. There is currently no word on whether the game will be out in English. Fans of JRPGs will be pleased to know that the Japanese RPG Atelier Ayesha will be localized in English for North American and European markets. The next game in the Atelier series will be out on March 5. Tecmo Koei will be handling the game's distribution while NIS America will be localizing the title. The game will only have English voiceovers; previous Atelier titles had the option to toggle between English and Japanese voices. The game stars an alchemist named Ayesha who is on a quest to find her missing sister Nio. The game features an upgraded version of the alchemy system prevalent in past Atelier titles. Players can craft their own items and weapons for use in defeating foes and helping townsfolk and people in the game's world. Valve has responded to user questions on the Steam forums surrounding the release of an unedited version of Left 4 Dead 2 in Australia, following the introduction of an R18+ classification for video games. Posting on the official Steam forums, Valve's Chet Faliszek told users the publisher has been exploring its options and investigating the legalities of what would be involved in releasing Left 4 Dead 2 in Australia with an adult rating. "No need to flood us with emails," Faliszek wrote. "We have been exploring the options here and what we can legally do. We will have more information on this when we understand the issues fully and how we are moving forward but don't worry any cost associated with it doesn't worry us, this is something we want to do." Left 4 Dead 2 was initially banned by the Australian Classification Board in September 2009 for "realistic, frenetic and unrelenting violence". Valve responded by re-submitting two versions of the game to the Board: the original, unaltered version and one with some modifications. A modified version of Left 4 Dead 2 was later released in Australia. This version of the game removed decapitation and limb dismemberment. Earlier this month, the Classification Board confirmed that the first title to receive the new R18+ rating in Australia will be Ninja Gaiden 3: Razor's Edge for the Wii U. A new expansion for Firaxis' 2010 release Civilization V could be on its way, according to a listing on the Steam Apps Database. The listing--first spotted on the 2K Games forums--clearly states "One World" as a PC expansion for the game, but provides no other details. The last expansion for Civilization V was last year's Gods & Kings, which added new civilizations, scenarios, and leaders to the game as well as a reworked combat system. A new report has surfaced, claiming to contain more details about Microsoft's proposed plans for the VoIP platform Skype, which the publisher acquired in 2011 for $8.5 billion. The CVG report cites an anonymous source "familiar with the matter", who reportedly told the publication that Microsoft is planing to consolidate its communications technology around Skype in the near future, including implementing it as the default chat service on the next-generation Xbox console, as well as on PCs and tablets. "You might jump to the conclusion that we'll see asynchronous voice and video messages in next-gen Xbox Live," the source told CVG. Skype's applications currently run both on home PCs and mobile devices, and use a peer-to-peer network for voice and video traffic. The company was founded in 2003.
